C’est ce que révèlent les résultats de l’enquête menée par l’éditeur américain de solutions de gestion du commerce international Amber Road qui a interrogé 123 Pme et grands groupes français issus de tous les secteurs. Seules un tiers des entreprises sondées sont certifiées Opérateur Economique Agréé (OEA) alors que depuis l’entrée en vigueur du Code douanier de l’Union le 1er mai dernier, ce statut revêt une importance considérable. Autre constat : dans 72% des cas, c’est le service logistique qui gère les questions relatives à la conformité douanière, « or les questions douanières sont transversales et impliquent également d’autres services tels que les achats et ventes qui ont la charge de vérifier l’origine des produits et leur commercialisation à l’aide de plusieurs listes, dont les listes de sanctions et d’embargos » commente Nicolas Ethevin, consultant chez Amber Road. Au niveau du management des entreprises, l’étude montre que près de 49% des dirigeants se disent conscients et impliqués dans la gestion de la conformité.

Fondée aux USA il y a 22 ans et côtée au NYSE, cet éditeur de solutions logicielles (présence dans 8 pays, 550 collaborateurs, 63 millions USD de chiffre d’affaires) propose une solution cloud associant modules de gestion du commerce international et base de données réglementaires sur 140 pays.

Le nombre des contraintes qui pèsent sur le commerce mondial se multiplie du fait de l’accroissement de la compétition commerciale entre les États au travers de réglementations douanières, sanitaires, techniques, de directives d’organismes internationaux, de listes de proscription (listes noires des armements ou des compagnies aériennes etc.)... Selon la structure des supply chains, les produits, les routes utilisées et les pays de destination, le corpus des obligations pesant sur un flux ou même sur un envoi peut varier de façon considérable. On voit apparaître aujourd’hui sur le marché une série de solutions informatiques permettant de consolider, à un moment donné, l’ensemble des obligations ou interdictions concernant un envoi international hors Union européenne.

Comme nous l'annoncions le 12 décembre dernier, Paul Simon-Thomas va développer l'activité de l'éditeur américain Amber Road en France. « Si les règles du jeu du commerce international tendent à se simplifier au sein de l'Union Européenne, elles se complexifient en dehors. Gérer cette complexité requiert désormais une approche industrielle », explique le Country Manager France d'Amber Road, en évoquant le cas de sociétés françaises (BNP Paribas, Alstom, Technip, Tota...) récemment condamnées à de lourdes pénalités pour le non-respect de règles anticorruption ou d'embargo.
